Wills and Estate Planning

This area is also considered to be a transaction type of legal matter. We have a will information form which starts the whole process. Return the form and we can discuss exactly what type of document you need.

Most people can solve their estate planning with a will. The purpose of a will is to dispose of property by naming a beneficiary for the property. The second, and for many people, the most important reason to have a will is to provide a guardian for a child or children. The number one reason most people never do a will is that they cannot agree on who to name as a guardian.       If you want to discuss this further and have your assets reviewed to make sure that they specifically will go to the people you have named then please call or email for an appointment.

Powers of Attorney

Illinois provides for people who wish to name people to make important decisions for them when something happens and the person is incapable of making a decision. This can be a serious illness or just being out of the state/country for an extended period. There are various types of Powers of Attorney and we are always happy to discuss this with you further.

Trusts and other Estate Planning
This is one of the most complex areas of the law. Tax laws and just general trust law make this a very intricate aspect to learn. This does not mean that the  issues are difficult to understand, just that the professional you hire to prepare these documents needs to make sure you understand exactly how this document will work for you.

Trusts come in so many types that the one which is right for each person completely depends on the person and the person's financial situation. Also, there are other estate planning devices which can be used instead of a trust or in conjunction with a trust to add to the disposal of assets when the matter involves different types of assets. We find trusts and trust-like devices common in family businesses, multiple real estate holdings, and estates valued above $300,000.00. These types of documents require a significant amount of customized detail and time to do well.

If you have further questions or are interested in this type of planning, then we request at least one initial meeting discuss the matter further. Fees and other costs can be discussed at that time. Call or email for more details.
